FIRST. - Absences and recuperation of classes.
(Student visa) The classes that the student does not attend for reasons beyond the school's control cannot be made up, nor will they give the student the right to claim any refund. Only classes in which the student has been absent for reasons attributable to FREEDA can be recovered. The classes will be recovered with the same type of course contracted with the date after the end of this contract.
(Course without student visa) Classes in which the student has been absent for reasons attributable to FREEDA or with 24 hours or more notice of absence may be made up. Classes will be made up at the same rate as the contracted course with the date after the end of this contract.
Course dates can be changed only if the Student justifies the reason for the request. The dates of the course will not be changed once the documentation has been submitted to the Consulate or to the Immigration Office. In case of rescheduling or freezing of the course, the Student has the right to resume the lessons within 12 months from the date of signature of the present contract.
SECOND. - Methodology and course objectives.
The Student will be assigned to a study group according to his/her level of language proficiency. For this purpose, FREEDA will provide the student with a placement test on the language of the course. FREEDA offers the language levels according to the standards of the Common European Framework of Reference for Languages, these being: A1, A2, B1, B2, C1 and C2 (basic, intermediate and advanced). The purpose of the course is that the Student, within the limits of the language level achieved, is able to perform in that language and is able to express and develop the four skills of the language: reading, writing, speaking and listening comprehension.
THIRD. - Schedule and group changes.
Changes in schedules and groups must be requested by students to FREEDA staff, and will depend on:
- On the availability of places in other groups and/or schedules.
- A sufficient level of the language to be able to join the new group.
That the Head of Studies determines that the change of group does not harm the proper performance of the group to which the Student intends to join.
FREEDA reserves the right to make changes of groups, address of their headquarters, schedules or teachers without prior notice to the student.
FOURTH. - Withdrawals and cancellation of courses.
4.1. In the event of force majeure or visa denial.
In the event that, due to a duly justified force majeure (catastrophes, wars, any other similar extraordinary event which the contracting parties could not foresee or which, if foreseen, could not be avoided; personal circumstances do not constitute grounds for cancellation of this contract) or due to the negation of a student visa processed for studies at the FREEDA school, the Student is forced to not begin the classes covered by the contract, the school will reimburse 85% of the total amount paid by the Student for the course not taken. The amounts paid will be refunded within 60 calendar days of the reception of the course cancellation form by FREEDA. In none of the cases will the student be refunded the amount paid in the concept of tuition, school counselling (asesoramiento), accommodation or classes used by him.
The Student must notify in writing via e-mail to [email protected] the reason that prevents him/her from starting the classes object of the contract and send the proof of the same within SEVEN (7) days after he/she becomes aware of the situation. The proof of visa refusal must also be submitted to FREEDA within the first 7 days.
4.2. FREEDA reserves the right to CANCEL courses.
FREEDA reserves the right to CANCEL courses that do not reach a minimum of SIX (6) students enrolled before the start of the course. In this case, FREEDA will reimburse the student the total amount paid. The amounts paid will be refunded within 60 calendar days of the receipt of the course cancellation form by FREEDA. If at any time during the course, the number of students in the group is reduced so that the established minimum of six (6) students per group is not met, FREEDA reserves the right to merge the group or cancel the course until there is another group of the same level. Under no circumstances will the amount paid for the course be refunded once the course has begun.
FIFTH. - Complaints.
FREEDA disposes of the Student Complaint Forms in accordance with the official model that can be provided to the Student.
SIXTH. - Right of withdrawal.
The Student is expressly informed that if this contract is a case of distance contracting of those regulated in Article 92 of Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws. the Student has a period of FOURTEEN (14) calendar days to withdraw from the contract without completing any formality other than notifying FREEDA.
The period shall be counted from the date of conclusion of this contract. If the student has started the course classes during this period, he/she will only be reimbursed for the proportional part of the services not received. The amounts paid will be refunded within 60 calendar days after the withdrawal of the student. The amounts paid will not be refunded to the student in the event of withdrawal from the contract once this agreement has been signed in person and the documentation has been collected by the student.
SEVENTH. - Protection of personal data.
By signing this document, I acknowledge having been informed, as prescribed by current legislation and the General Data Protection Regulation on the incorporation of my data to files in which these will be processed to comply with the legal issues relating to my activity, the possibilities of access, rectification, cancellation and opposition on them and expressly consent to the collection of data and the treatment of them by both FREEDA LANGUAGE SPACE, S.L. as well as by those organisations to which I provide my data in order to comply with the different legal and contractual obligations and those others necessary for the development of the company's activity.
